Welcome to UnitedSets Tennis. These Terms of Service ("Terms") govern your access to and use of the UnitedSets Tennis website located at unitedsets.org, mobile applications, and related services (collectively, the "Service") operated by UnitedSets Tennis ("we," "us," or "our").

1. Acceptance of Terms

By creating an account, registering for a tournament, booking a court, or otherwise using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using our Service on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

To use our Service, you must:

• Be at least 13 years of age (users under 18 must have parental or guardian consent)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using our Service under applicable law

For youth tournament participants under 18 years of age, a parent or legal guardian must create the account, complete registration, and agree to these Terms on behalf of the minor.

3. Account Registration

Account Creation

To access certain features of our Service (such as tournament registration or court booking), you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

Account Security

You are responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

4. Our Services

UnitedSets Tennis provides the following services through our platform:

• Tournament Registration: Online registration for youth and adult tennis tournaments in the Tristate area
• Court Booking: Reservation system for tennis court rentals
• Match Play Programs: WTN, UTR, and other competitive match play sessions
• Training Programs: Camps, fitness training, private lessons, and team programs
• Information Services: Tournament schedules, results, news, and community updates

We reserve the right to modify, suspend, or discontinue any aspect of our Service at any time without prior notice.

5. Payments and Refunds

Payment Processing

All payments are processed securely through third-party payment processors (Stripe and PayPal). By making a purchase, you agree to the terms and conditions of these payment processors.

You represent and warrant that you have the legal right to use any payment method you provide.

Tournament Entry Fees

Tournament entry fees are displayed at the time of registration and must be paid in full to complete your registration.

Refund Policy

• Cancellation by Player: Refund requests made more than 7 days before the tournament start date will receive a full refund minus a $10 processing fee. Requests made within 7 days of the tournament may not be eligible for a refund unless due to documented medical emergency or extenuating circumstances.
• Cancellation by UnitedSets: If we cancel a tournament or program, you will receive a full refund of all fees paid.
• Weather Cancellations: In the event of weather-related cancellations, we will attempt to reschedule. If rescheduling is not possible, refunds will be issued on a pro-rata basis.
• Court Bookings: Court booking cancellations made at least 24 hours in advance will receive a full refund. Cancellations within 24 hours are non-refundable.

6. Tournament Rules and Conduct

Tournament Participation

By registering for a tournament, you agree to:

• Comply with all tournament rules, USTA regulations (where applicable), and the USTA Code of Conduct
• Arrive on time for scheduled matches
• Conduct yourself in a sportsmanlike manner
• Accept the decisions of tournament officials and referees
• Treat other players, officials, and spectators with respect

Assumption of Risk

Tennis is a physical activity that carries inherent risks of injury. By participating in our tournaments and programs, you acknowledge and accept these risks. You are responsible for ensuring you are physically fit to participate.

Media Release

By participating in our tournaments and events, you grant UnitedSets Tennis permission to use photographs, video recordings, and other media of you or your child for promotional and educational purposes, including on our website, social media, and marketing materials.

7. Acceptable Use

When using our Service, you agree NOT to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Submit false or misleading information
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any illegal or unauthorized purpose
• Harass, abuse, or harm other users
• Transmit viruses, malware, or other harmful code
• Scrape, data mine, or collect user information without consent
• Use automated systems (bots) to access the Service without permission
• Engage in any activity that could damage our reputation or goodwill

Violation of these terms may result in immediate termination of your account and access to our Service.

8. Intellectual Property

Our Content

The Service and its original content, features, and functionality are owned by UnitedSets Tennis and are protected by copyright, trademark, and other intellectual property laws. This includes, but is not limited to:

• The UnitedSets name, logo, and branding
• Website design and layout
• Text, graphics, images, and photographs
• Software and code

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Service for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without written consent
• Remove any copyright or proprietary notices
• Create derivative works based on our content

9. User Content

You may have the opportunity to submit content through our Service, including profile information, comments, and feedback ("User Content").

By submitting User Content, you:

• Retain ownership of your User Content
• Grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your User Content in connection with our Service
• Represent that you have the right to submit the content and that it does not violate any third-party rights
• Understand that we may remove User Content that violates these Terms

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any information obtained through the Service

We do not guarantee the availability of court times, tournament spots, or any specific services at any given time.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNITEDSETS TENNIS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or goodwill
• Any damages resulting from your use of or inability to use the Service
• Any personal injury or property damage resulting from participation in our tournaments or programs

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless UnitedSets Tennis and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your participation in our tournaments or programs

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us at admin@unitedsets.org.

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and any associated data (subject to our data retention policies)
• Any outstanding payments owed by you will become immediately due
• Provisions of these Terms that by their nature should survive termination will survive

14. Dispute Resolution

Informal Resolution

Before filing any formal legal claim, you agree to contact us at admin@unitedsets.org and attempt to resolve the dispute informally for at least 30 days.

Arbitration

If we cannot resolve a dispute informally, you and UnitedSets Tennis agree to resolve any disputes through binding arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.

Arbitration shall be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will take place in New York County, New York.

Class Action Waiver

You agree that any arbitration or proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in New York County, New York.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website with a new "Last Updated" date
• Sending an email notification for significant changes (if you have an account)

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
